dc.description.abstractEl reciente código de procedimiento penal, ley 906 de 2.004, ha diferencia de lo que hacía el anterior, no se refiere expresamente al ejercicio de la acción civil dentro del proceso penal, ni tampoco hace alusión a la parte civil dentro del mismo. En vez de ello, el legislador optó por referirse a la víctima y a una participación suya sui generis en nuestra tradición, en la medida en que se le trata como interviniente, como parte, se le permite actuar sólo por intermedio de la Fiscalía y otras veces de manera autónoma e independiente.spa
dc.description.abstractenglishThe recent code of criminal procedure, Law 906 of 2004, is different from what the previous one did, it does not expressly refer to the exercise of civil action within the criminal process, nor does it refer to the civil part within it. Instead, the legislator chose to refer to the victim and his sui generis participation in our tradition, to the extent that he is treated as an intervener, as a party, he is allowed to act only through the Prosecutor's Office and other times autonomously and independently.eng
