| dc.description.abstract | Llegar a establecer las contradicciones existentes entre los elementos de la teoría del delito y la forma de ejecución de la pena en Colombia, supone de una parte, reconocer que la tipicidad, la antijuridicidad y la culpabilidad, constituyen barreras de contención frente al poder punitivo del Estado, y de la otra, que su interpretación a la luz de los derechos fundamentales permite reivindicar una concepción democrática del derecho penal, que sin lugar a dudas encuentra soporte en la Carta Política de 1991 y en los instrumentos internacionales de derechos humanos. | spa |
| dc.description.abstractenglish | Establishing the contradictions between the elements of the theory of crime and the method of carrying out punishment in Colombia requires, on the one hand, recognizing that criminalization, unlawfulness, and culpability constitute barriers to the State's punitive power, and, on the other, that their interpretation in light of fundamental rights allows us to vindicate a democratic conception of criminal law, which undoubtedly finds support in the 1991 Political Constitution and international human rights instruments. | spa |
