dc.description.abstractLa creación del sistema penal acusatorio aportó innumerables beneficios en pro de las victimas, los procesados y el Estado, pero a su vez trajo consigo dudas, incertidumbres y vacíos. Quizás uno de los vacíos que genera más dudas e incertidumbre en la actualidad es el de la confesión y sus efectos en el proceso penal. Dudas e incertidumbres que deben ser sorteadas a lo largo del proceso y que implican, una gran inseguridad jurídica para las partes y para la sociedad en general. Lo anterior no obsta para que tal vacío sea subsanado con el paso del tiempo teniendo en cuenta que la introducción de un nuevo sistema procesal penal conlleva consigo algunos defectos que son subsanados a medida que se presentan nuevas situaciones. dc.description.abstractenglishThe creation of a new accusatory system brings many benefits to the victims, the criminals and the state but also brings doubts and uncertainties. Maybe one of the doubts what generates more uncertainties is the confession and its effects on the criminal process. Uncertainties that have to be bypassed on the course of the process, bringing with it a huge juridical insecurity to the parts of the process and the community in general. The previous precept doesn't mean that those doubts can not be fixed by the pass of the time. In fact, the problems that the introduction of a new criminal process brings with it also brings new solutions for every particular case. Those cases are analyzed in this paper.eng
