| dc.description.abstract | Con base en un estudio en la región del Urabá este artículo aborda las consecuencias concretas de la violencia armada en el funcionamiento de la JEP, jurisdicción que combina los enfoques de la justicia penal retributiva y la justicia restaurativa para contribuir a la justicia, la verdad y la reconstrucción del tejido social, mediante la participación efectiva y signi!cativa tanto de las víctimas y como de los comparecientes. En este marco, el artículo contribuye a la identi!cación y comprensión de los riesgos concretos que la persistencia de violencias representa para la participación en procesos de justicia transicional. Se analiza cómo la participación de los principales actores se puede ver restringida de diversas maneras, dando lugar a un “efecto dominó” de impacto negativo sobre los objetivos de la JEP como el acceso a la verdad, la justicia y la reconciliación. | spa |
| dc.description.abstractenglish | Based on a study in the region of Urabá, this article examines the concrete consequences of armed violence on the performance of the SJP, a jurisdiction that combines the approaches of retributive criminal justice and restorative justice to contribute to justice, truth and the reconstruction of the social fabric through the e"ective and meaningful participation of both victims and participants. Within this framework, the article contributes to a better understanding of the concrete risks that the persistence of violence poses for transitional justice. From there, the article analyzes how the participation of the main actors can be restricted in di"erent ways, giving rise to what can be considered a “domino e"ect with a negative impact on the objectives of the SJP, such as access to truth and justice and reconciliation. | eng |
